Subcommittee, which is being held as a remote meeting. This meeting is being webcast, so
please bear with us if there are any technical issues. My name's Councillor Mitten. I'm chairing
this meeting. What I'll do now is invite the other attendees to introduce themselves in

confirm that we did email the applicants. I sent a further email this morning and was
updated this morning they'd be attended, so I haven't had a chance to do any kind of testing
or troubleshooting with them via Teams.

My name is Belinda Louiso, I am a police licencing officer on behalf of the
Metropolitan Police. Thank you.
Fantastic. And then we've got Mr Johnson as well.
Yes, I live in the flat above the shop. I'm the owner of 82 A Tooting High Street.
Fantastic. Thank you. I think that is everybody now. So move on to agenda item one and two,
which are apologies for absence. Mr. Flowers, I don't think we have had any but use this
opportunity to declare any of those.
That there are none, Chair.
Fantastic. And then any declarations of interest for any items on the agenda?
No. Okay. In that case, we move to agenda item three. We will now consider the application
for a variation of premises licence in respect to the premises known as KK Convenience Store,
82 Tooting High Street, London, SW 17 0 RN. And I now invite the licencing officer to
introduce the application. Thank you, Chair. Kavikumar Paramasivan has applied for a variation
to their premises licence at KK Convenience Store, 82 Tooting High Street, SW 17 0 RN,
to extend the hours for the sale of alcohol for consumption off the premises
until 2 a .m. Monday to Sundays. The current licence has an end time for
alcohol sales as 11 p .m. Monday to Saturday and 10 30 p .m. on Sundays.
There's no change to the start of alcohol times or their opening times
which are not restricted. Appendix C of the committee report provides the
current timings for the licence and the proposed and the new proposed hours in
read. The application was advertised as required under the legislation,
with site notices at the premises and with a newspaper advert.
These were both confirmed as correct by licencing officers.
This resulted in the receipt of three representations from
responsible authorities. The police,
trading standards whose conditions were agreed by the applicant during the
consultation period, and the licencing team.
There is also a representation from another person who is requesting that the committee
refuse the variation in line with the Council's own cumulative impact policy.
These representations are the only matter for consideration tonight.
Appendix A to the report lays out the conditions arising from the applicant's operating schedule,
including those currently on the premises licence which are in black and the proposed
and agreed conditions which are in red.
These will become additional conditions of the variation if it is granted.
Appendix B to the report lays out the further suggested conditions.
Councillors, the options that are open to you tonight when deciding this variation include
granting the application as requested or modifying the conditions of the licence,
alter or omit conditions or add new or reject the whole or part of the application.
Councillors, I've laid out the brief facts of the application,
but I'll be happy to answer any questions you may have. Thank you.

I'll take that as a no. Just to give people a note, I will now invite the applicant to address the
the subcommittee. So we'll have the applicant address the committee. They can have up to
five minutes to address the committee and then committee will be able to ask questions.
We'll then move on to the representations who will have equal sum of time and will have
questions as well. So there's opportunity from both sides to speak and have clarification

Hello, yeah actually we applied for extension from 11 to 2. If we give that opportunity it will be good for our business because nowadays business is very quiet at least if we extend we will do some good business.
That's the main hour request.
Okay, did Kartik also have an opportunity, you've got up to five minutes to address the
committee, just give you that full opportunity.
As Kavikumar said, yeah, this extending the time will be beneficial for us and also we
we will consider whatever the council given us. I mean like if we here I mean
we have two people in place so that I mean we have one person working at the
till and we have another person like a security like who's always around so the
we consider about you know not selling alcohol just to be to the person
who is really too much drunk or something like that when they come and
refuse the sale of alcohols. Yeah reasonably considering the people who
were coming in we would prove I mean like pro -rata calculate them and then
yeah depending on that we sell the alcohol.
So if you're given an opportunity yeah yeah we would be would I mean if the
police has any issues we would love to work along with them and then you know keep everything in track.
Fantastic and you do have another three minutes if there was anything else if not I'm happy to move on to the subcommittee asking any questions of clarification about your application if you're content for that.

Uh was one person in the till and then uh we have two literally two people working one person in the
filling and then yeah sort of we have three staffs working in the evening times normally.

Is there currently no CCTV in the shop? There is a CCTV.
Okay, so but you'll instal a more comprehensive CCTV system?

At the moment we don't have much of any issues going around.
Okay, so any potential issues might then happen outside of the shop you would say?
outside of the shop? I don't think so. I don't think so as of now we haven't seen any issues as such.

I did have a clarification on the training that you, one of the conditions that you put in your application around training to staff.
Could I just get clarification that would be all the staff in the shop and that would be mandatory for all of them?
Just wanted to get that clarified.
Yeah, just when we talk about the staff training, yes under 25 and all these trainings or weekly trainings have been given to all the staff.
So that they are aware of what things are, what under 25 is and who we can serve alcohol and all these things.

from the applicant. I'll now invite those making representations to address the subcommittee
and you'll have up to five minutes in total. So I don't know whether you wanted to organise
it just who speaks first. I am again, I'm not pointing to you all the time, Mr. Stevens,
but you're always in my eye line. So I don't know whether you wanted to go first and to
go around in that way.
Thank you, Trevor. If it's okay with you, can I ask the police to make their representation
before mine and mine will fit in quite nicely after that. Thank you.
Absolutely. Thank you chair.
So on behalf of the Metropolitan Police I do maintain the objection in relation to this
application on the grounds of the Prevention of Crime and Disorder. I do acknowledge the
the applicant's amendments and the additional conditions offered.
However, the premises still remains in the Tooting Broadway CIZ, where there is the presumption
to refuse applications that are likely to add to the CIZ.
Tooting Broadway continues to experience significant levels of violence and social behaviour.
And the police data shows rising crimes and the council's policy also identifies that late night alcohol availability and off -licences do contribute to these problems.
As I said, I do welcome the proposed conditions, including the restrictions on high -strength
alcohol and the ban on single cans and the additional staffing.
However, this is sort of management measures within the shop and they don't remove the
fact that the application still seeks later alcohol sales within this area.
I just wanted to point out I noted that the applicant has now offered to restrict the opening hours of the premises
So they're aligned with the proposed sell of alcohol hours
so
But if that's as the applicant said it's to do some some good business
I'm just wondering why those hours are restricted
when the premises can stop the alcohol sales and then they could
potentially benefit from selling other products inside if I hope that makes
sense. I'd also like to highlight to members the evidence provided by our
local Savour Neighbourhood Sergeant who's responsible for shooting Broadway and
and this evidence confirms that officers regularly deal with alcohol related
anti -social behaviour, street drinking and intoxicated individuals, requiring police.
We know that local businesses and the community premises have reported problems with groups
of persons drinking in public places in the early hours and also identified the hotspots
for violence, violent offences in the late night period.
The Sergeant's evidence is that individuals are drawn to the area because there are lots
of licenced premises.
Blatant alcohol is available and I believe extending the alcohol sales later in tonight
would also have a detrimental effect on the officer's efforts and the police efforts to
to reduce crime and social behaviour. And for those reasons, Chair, the Metropolitan
Police respectfully request that the Licence Subcommittee refuse the application. Thank you.
Thank you. Mr Stevens, did you want to go next?
Thank you Chair. Speaking on behalf of the licencing authority as a responsible authority,
going on from what you've heard about crime, antisocial behaviour, disorder in the area of
Tooting Broadway, these figures provided by the police are also backed up with our own research
as well and in particular two licencing policies that need to be considered
when determining this application. Now we have a statement of licencing policy for
the whole of Wandsworth which requests or basically states that we would require
any alcohol premises for off sales if they are selling late at night then
those terminal the terminal hour is midnight Sunday to Thursday and 2 a .m. on a Friday and
a Saturday. So this application by moving on so Guy did you want to come in? I was just to
make sure that it was clear that the guideline now is not set hours so you're aware.
And then moving on to our cumulative impact policy. This relates to alcohol sales or off
sales for alcohol in the area from where this application sits. And there are a number of
elements there where this application does not satisfy any of the cumulative impact policy
requirements. It's an area which is already deemed to be saturated with
alcohol sellers and any premises no matter how well run is if there's more
alcohol being supplied in a cumulative impact area then it will have a negative
impact. It will increase the amount of alcohol that is available in that area
and there will be an increase in antisocial behaviour and crime and
problems issues are already reported in this area associated with alcohol.
Now our cumulative impact policy also suggests that there are times in which we
or the subcommittee could allow an application to be granted but these would be if the supply
alcohol is ancillary to another type of business. So you could have providing
champagne with flowers or wine with cheese but this application is merely to
increase the hours and the availability of alcohol in an off -licence shop. As you
just heard this is to assist the business and we're given no other
assurances. I'm just going to very quickly go to the application itself
because I do have an issue with a couple of parts of the application.
It's unfortunately, unfortunately that the person who wrote this application
is not present because, um, it does appear to be quite a bit of, um, copy
and paste in, uh, with that application.
Um, which wouldn't normally be a problem, but I'll just mention the fact that in
the section B where it refers to CCTV, um, apparently the CCTV will meet the minimum
requirements of Hounslow police licencing team.
There is a whole paragraph that is repeated straight after the previous one.
It just, and because there are parts in this application that mentioned how the applicant is
going to deal with the potential impact to the licencing objectives, I'm not convinced
that the applicant is actually aware of these conditions that he's put up. So,
One of them is that the licence holder will maintain a positive working
relationship with the Metropolitan Police and local Safer Neighbourhood
team and I really would like to know how they propose to do that and if they have
contacts with the police or the Safer Neighbourhood team already is there
already a relationship there and also that staff will remain and will receive
awareness training in relation to the welfare of vulnerable persons. I'd like
That training will take, where will the training material come from?
And, um, at the moment, um, with the applicant, just not explaining
enough how he proposes to, um, to deal with the potential negative impact.
Then, um, I'm not convinced that it just looks like it is cut and paste document.
And it looks like these are just words on a page.
So it is the opinion of the licencing authority as a responsible authority
that any increase in alcohol will cause more problems.
This application has simply not addressed that negative impact.
And I would urge the subcommittee to refuse this application in full.
I have put some conditions at the end of my representation should the subcommittee
be minded to grant the licence and that deals with some high ABV strength. Five
and a half percent ABV for beer and cider is considered strong beer or
higher than that is considered strong beer and we find in many many off
licence shops where we have anti -social behaviour connected with those premises
that the favoured drink of choice of street drinkers are the very strong
alcohols beers and ciders that are over five and a half percent because they are
cheaper and they get a stronger hit from it quickly that's all well documented so
we would absolutely like to deal with that and also to reduce the amount of
alcohol that is on display to not to exceed 20 % of the premises display area
But as I said, any addition, and we are looking to go another 23 and a half hours per week
at the time in which is where we suffer the most problems, it would be very, very difficult
for both us and the police and local residents.

Well, I have no desire to harm the applicant's business and I can understand that he may
wish to gain a competitive advantage over Sainsbury's by having slightly longer opening
hours and attracting passing commuters, but I do have concerns about attracting drinkers
to the area from elsewhere. All the residents have back alley entrances and once people start
hanging around those entrances and vomiting basically at the entrance which is the sole
entrance to quite a lot of properties. Those issues we have had in the past. We haven't got
them at the moment and I'm noticing there is a lot of noise regularly around the I think it's
called the Rheinoy convenience store opposite Sainsbury's. I mean, people who don't live
here wouldn't know, but for me, I look out the window, I constantly see some sort of
issues outside of that store, which is open all night and doesn't even sell alcohol. So
long opening hours are problematic and long alcohol opening hours, especially if alcohol
is on sale once JJ Moon closes, which I believe is open till midnight during the week.
I mean then you will be certainly attracting people. We see drinkers hanging out in Garrett
Terrace, that's the next side street where the Gilby Road entrance is not currently hanging out.
This part of the high street is relatively quiet, whereas the part opposite Sainsbury's with a 24
our shop is really quite noisy and I'm not sure that, I mean as a resident I see and hear it so
constantly and we would be personally impacted in our neighbours. There are a lot of residents,
a lot of flats in this area. That's the main concern I have.

What I'm going to say is the representations had slightly longer and I want to make this
fair so that the applicant has equal amount of time.
So to give the opportunity to the applicant now, if you did want to speak for a bit longer
then that opportunity is there.
You will have an opportunity at the end of this meeting to have up to two minutes to
address the committee, but I just wanted to give that opportunity there just to make it
fair. If not, I'm happy to move on. Okay, I'll take that as happy to move on. I'll invite
the subcommittee to ask any questions of the representations. So, Councillor Glynn or Councillor
do if you had any questions as clarification. I just had one, don't know if, Linda, whether
you would be able to come to this, I appreciate that it was your colleague who submitted the
data in terms of where the crimes were being committed, how many crimes were being committed.
Just to clarify whereabouts in the ward where those hotspots potentially were,
just to get a bit more information on that and some clarity.
So is that within the Sergeant's statement, Chair?

Okay, let me just have a quick look at it. Bear with me for one moment.
So in regards to the hot spots, I'm just having a look at the end of the statement, the last
paragraph. So I've got Sainsbury's Tooting Hire Street report that a number of evenings,
large groups of people have been drinking at their back entrance until 4am where intoxicated
people have tried to climb fencing and open cans of alcohol are left behind causing litter
which needs to be cleaned up before their opening hours. Are you happy for me to read on?
Sorry, I was looking at, I was from yours, so I'm just looking at the data from your statement.
So you've got the offences from January to April 2026. It was just getting a sense
where that some of those, those were just to give a bit more information, that was all.
Yeah, no, I understand. That's literally just the tooting Broadway whole area.

Yeah, so as I stated before,
I would maintain this objection to refuse the application
to extend hours of alcohol sales for consumption off the premises and I do
not believe the I do believe that any further extension of alcohol hours will
add to the CRZ in Tooting and yet respectfully request the licencing
committee subcommittee members refuse the application. Thank you.
Thank you. Sorry, I'll just mirror what Belinda has just said as well. We have a cumulative
impact policy. The research, due to research and investigations extensively going into
crime, antisocial behaviour in this particular area has identified this area as a hotspot
already saturated with alcohol premises so that evidence underpinning the
publication of a cumulative impact assessment should generally be suitable
as a basis for a decision to refuse an application. It would require the
subcommittee to deviate from the cumulative impact policy and also the
council's own statement of licencing policy. So we firmly believe that this
will add to issues and we would urge you to refuse this application. Thank you.
Mr Johnson, you've got about 25 seconds.
I would suggest midnight might work but if you're gonna stay up until 2 a .m. you're asking for
trouble in my opinion. I think that's unrealistic. You will invite clinkers
from outside and there will be problems for residents.

We will follow all the rules and as Tabikumar said, if we can make it until 12, as our neighbour
as well, he said that making it as a two o 'clock will make a hassle. In that case, we would request
it until 12 p .m. Is that okay? If it's okay for everyone, just considering like two hours of
extension to up to 12 o 'clock like if you see the Tooting High Street the most
of the shops are open till 12 so we would request the same like until 12 p .m.
so no decision is made in this but this is just to allow you the opportunity for
