to chair. It might therefore be worth to start the meeting and go through the routine items
of declarations of interest and just to go through the attendees in the meeting. If Councillor
Verathlorin is able to join in that time then we can continue with her but otherwise we
may need to look at continuing in her absence, noting that the quorum for a licencing subcommittee

this meeting of the Licencing Committee which is being held as a remote meeting.
It's also being webcast. We've already asked you to bear with us if there are technical issues,
but obviously if there are any more as well. As Michael said, my name is Councillor Mayorkas. I'm
a Councillor in Trinity Ward, Tootingham, Ballam and I will chair this meeting. I will now invite

Hi, good evening. Good evening. My name is Hamish Ross and I form one half of Rosalee Holdings.
Sorry, Lana, I think I cut you off there. That's okay Hamish. Lana Trigger from LT Law and I'm
the applicants this evening. I'm Richard one of the co -oplicators along with Hamish.
I'm Shana McKenzie, I'm just a local resident in favour. Perfect and then I can see Robert
and then Guy if you want, sorry Robert and then Charlie and Evan. Robert I think you're
meat I'm afraid absolutely right I was thank you Robert Humphries nearby owner
freeholder thank you Charlie thanks very much Evan I am a local business owner on
Eric Road and a local resident. Thank you. Have I missed anyone out? No. Wonderful. Okay,
great. So agenda item two is apologies, but we don't have any apologies. That's fine.
And then third agenda item is declarations of interest. So if there are any declarations
of disposable, displaceable, pecuniary interests, other registered interests, and any non -residential
interest relevant to any matters to be considered at this meeting?
Assume not. Okay fantastic. Moving on to generalising for them which is now to consider the
application for a new premises licence in respect to the premises known as Rosales, 344 to 346 Old
York Road, SW18 1SS. And now I now invite the licencing officer to introduce the application
please. Thank you Councillor. Rosali Holding Limited have applied to
Wandsworth Council for a new premises licence for Rosalis at 344 to 346 Old York Road, SW18 1SS.
For the sale of alcohol for consumption on and off the premises, the provision of regulated
entertainment for recorded music only as live music was withdrawn by the applicant, and late
night refreshment. Apologies Councillors but there are some errors to the report with regard to
Appendix B, page nine of the report,
which provides the timings for the activities
being applied for.
The error is in relation to the timings
for the sale of alcohol on the premises,
which the report incorrectly states
as 10 a .m. until 2 a .m. Fridays and Saturdays.
This should be 10 a .m. to midnight.
Page seven of the report, a proposed condition four.
This was missed where there was an agreement
reached with the police,
where the applicant agreed to accept the following wording
for the security incident logbook, which will now be an instant log shall be kept at the
premises and made available on request to the Metropolitan Police, the licencing authority
or other responsible authorities. It must be completed within 24 hours of the incident
and shall record the following. All crimes reported to the venue, all ejections of patrons,
any complaints received, any incidents of disorder, any refusals of alcohol, all seizures
of drugs or offensive weapons, any faults in the CCTV system and any visit by a relevant
authority or emergency service.
The applicant also agreed with the police to add an additional condition on Condition
1 for the CCTV that CCTV at the venue will cover both the internal and external areas.
The application was advertised as required under the legislation with a site notice at
the premises and a newspaper advert.
This resulted by the end of the consultation of seven valid representations from other
persons against the application and 29 representations in support of the application. These representations
are the only matter for consideration tonight. Councillors, the options that are open to
you tonight when deciding this application include granting the application as requested
or modifying the conditions of the licence, alter or omit conditions or add new or reject
the whole or part of the application. Councillors, I've laid out the brief facts of the application
and I'll be happy to answer any questions you may have. Thank you. Thank you very much for that.

on anything that's been stated. As a reminder, obviously, both applicant and anyone making

of clarification essentially.
Good evening. I just have one point, quick query.
At paragraph two of page three of the report, it's referred to the old licence at Conigans, which lapsed.
I just wondered if you could confirm that the hours applied for here are the same as the previously held hours for Conigans.
Was that what was applied for?
Yes.

Okay, fantastic. Okay, in that case I will now invite the applicant to address the subcommittee.
Go ahead. Thank you and good evening everyone. I act for Asali Holdings Limited. The premises were
previously licenced as Conigans, which was a much -loved restaurant in the local area. Sadly, the owner
died and a transfer wasn't done within the 28 days of the death and so a new licence application is
required. As you know my client directors are in attendance and they both are extremely experienced
in the hospitality sector. Hamish has been in operations and management for over 18 years
and Richard is currently the Executive Chef at Claridges, previously Head Chef at the Goring Hotel
where he was awarded a Michelin Star for the restaurant. Richard's obviously in charge of the
here offering what we say will be European comfort food classics. Richard's
lived in the area all of his life in the UK and knows the area and understands
the area. He's actually giving up his job and will dedicate his career to this
venue so the quality of food will be spectacular but we're going to be
accessible in terms of price. Rosales will be a neighbourhood
restaurant brasserie. It will be open breakfast, lunch and dinner. There'll be
around 20 staff I'm told and the decor will be fully laid tables stripped back
with natural finishes. There's a small bar as you can see on the plans and the
ground floor and there'll be tables laid out. There'll be waiter and waiters
service throughout the premises. The entire basement's
back of house so that's around 40 % of the total area is dedicated to the
kitchen and operations. There's no licensable activities in the basement.
This application seeks to replicate the previous licence in full, the same hours as previously
held.
The premises operation will stay the same, different food decor and ownership of course,
but it will be a food led brasserie restaurant.
I appreciate this is a new application, but it is the same site and considerations.
The Conigans licence had late night refreshment, recorded music and retail sale of alcohol
from 10 a .m. to midnight Monday to Saturday and noon to midnight Sunday as
well and that's what we're seeking to apply today. We have withdrawn live music
as we've heard. Interestingly and helpful to the objectors, the old Conigans
licence had only two outdated conditions on it and one was unenforceable since
the conversion so there's only was only one practical condition. What my client
is proposing is the same hours as Conigans but 17 enforceable conditions that crystallise the
operation and offer protection to the residents. There's no representations from the police or
environmental health or other responsible authorities which is telling. The hours are
within the council's guideline hours and the hours are important to the business model.
Now this application has had overwhelming support from local residents. 29 residents have written
to the council supporting the application and one supporter in the
papers lives above the premises and he has no concerns. There do remain seven
representations from residents who have objected and my clients worked very hard
to engage with these residents. Some have withdrawn as a result of conversations.
Hamish has had emails and calls and with others to explain his concept and he's
met with some objectors earlier this month. The objectors are exactly the
clientele they want and so we've been very engaging with these people. In terms
of the objections, the premises is a commercial space and he has a lease. The
same hours are being applied for as what was previously held. There were some
concerns with noise, understandably so. We've withdrawn live music and acoustic
considerations will be dealt with during the fit out and Hamish has already
spoken to one neighbour about this. There were some comments about smokers and we do have to
cater for them, although we're not expecting there to be many and these will be directly out the front
of the premises but monitored by staff. We have condition that the litter, any smoking litter will
be cleared up regularly. We've got two outside areas, there's the front and this will be subject
to a pavement licence and this will be applied for separately as members will be aware.
There's also a small rear garden where no pavement licence is needed, but we
confirm we've offered a condition that the outside spaces will close at 11
o 'clock Monday to Saturday and 1030 Sunday in line with the council's
guideline hours. No regulated entertainment is sought for outside the
premises. We've also offered conditions about training which Hamish is very
familiar with, notices and police matters such as CCTV, age cheques and incident
logs. There'll be no increased traffic or noise as a result of this application or this licence
continuing in this space. There's no change in capacity and there'll be local clientele so we're
not expecting any increase in new journeys as a result of this application and as we know it's
pedestrianised out the front of the premises. As a brasserie restaurant we also need to note that
there will be a natural dispersal of patrons from the premises. There'll be sitting times, bookings,
People will arrive, be seated, order their food, eat, pay and leave when finished.
Old York Road is pedestrianised so there's not going to be any cars or vans out the front of the premises
and produce will be carried or wheeled up.
In terms of waste, the rear alley is used by other nearby operators. They use First Mile and we intend to do the same.
and this would collect with those businesses.
So we're again not creating any additional noise
from waste collection.
This application has to be considered on its merits
in accordance with the licencing authority's
statement of licencing policy.
And the new guidance from November also states
that when making licencing decisions,
the licencing authorities need to consider
economic benefits that promote growth as well,
which this premises will do as a new business.
So we are seeking to trade to the same hours as previously held, and this is with the employment
of staff, the economic benefits to the area, and with 17 restrictive conditions, which
I can go through if needed, but they're in the papers.
There's no crime and disorder concerns or noise concerns from environmental health,
so this application, we would say, can be granted supporting the licencing objectives.
Hamish, I might just, if I have a few minutes, I'll just ask Hamish just to explain the concept
in a bit more detail so members are aware of what will exactly what will be happening
at the premises. Hamish, can you just go through a bit of the concept further?
Yes, absolutely. Just with respect to one item you mentioned there, and that was the
engagement that Richard and I have had with some of the objectors. I must just say to
Mr. Humphrey's apologies because one of the objections noted that they didn't
wish for their details to be shared. I unfortunately mistakenly thought that
was you. It was on consecutive lines. So apologies for not reaching out to you.
But I actually had misread it as not to be shared, i .e. not to be contacted.
So apologies. But yes, regarding the concept, Lana's touched on it in general
terms but it's very much a neighbourhood concept. We'd like, Rich and I would like for this to be
a local hoard, something that replaces Conigans, that pays, effectively pays homage to what
Conigans was and everything that we've heard about Conigans from the locals that we've engaged
with thus far and that is largely that it was like a much -loved local spot. You know, one of
the objectors that I sat with a couple of weeks ago said that she visited on average
at least 10 times a week.
She was almost embarrassed how often she was there.
So we're not looking to,
as an operator, that's a very valuable thing
to have such loyal customs.
So we're not looking to do anything
that would detract from that.
We're very much looking to build upon a solid foundation
that was Conigan's for many, many decades.
And with that, hopefully, effectively,
create the Conagans 2 .0. The concept itself is going to be appreciative of the changes
that have happened on Old York Road. Lana has mentioned that obviously the tables and chairs
licence and pavement licence would be separate, but we're aware that that space has been created
by the council for a reason and we would love for our restaurant to benefit from that.
Given the outdoor space, our concept is around a kind of a European continental feel.
Richard's heritage is Italian.
And whilst we wouldn't just wish to be an Italian, we don't want to pigeonhole ourselves too tightly,
we'd like to have a continental feel about it.
And that will be reflected not just in the space that we create, but also the menu and the offering.
I think that's probably a fairly concise summary. If there's any more questions,
obviously Richard and I can take them and expand.

Cool, thanks both. Any questions from councillors? Julie, sorry if you've got that information you wanted to come in.
Yes, the hours are in line with what the old Conigans licence is, except for the opening
hours which had no restriction before, but this new licence application has closing times,
so that is different, and also the external areas.
Can I just say, Conigans I think was open earlier in the morning.
I have no restriction on their opening hours so they may have opened for
breakfasts or so forth. Yeah they do. The alcohol they should not have been
selling it until 10 a .m. Oh I see okay that's correct.
Councillor Burch your question for the applicant? Yes I think the main concerns
that residents have is the noise and you said you're going to do acoustic
checking for when the building works is done so that's one thing. My other
concern is the outdoor space being open until 11 o 'clock at night which you know
in the height of the summer when all of your neighbours will have their windows open is
quite late and I can appreciate their concern about that noise. Would you consider bringing
customers in a little bit earlier? I think the condition that we've proposed
is that the seating will be ending at 11 o 'clock, so customers will be filtered out prior to that
time. I think with all outside areas, it goes towards management of the premises. It won't be
a large space in terms of the number of clientele through there. They will all be seated as well,
and it will be staffed with waiter -waitress service out into that area. I think Hamish is
confident in terms of that space with the management and he has extensive experience
dealing with
premises and monitoring them and
and leading from leading from above in terms of noise disturbance.
Hamish, do you want to go through sort of how that will be managed so that the councillors are aware in terms of noise?
Yeah, absolutely. So with the, I don't know how familiar everyone is with the Colligan's premises,
but the second half of the premises, the rear of the premises, away from Old York Road,
it's in effect a conservatory that then leads on to a slightly oddly shaped outdoor area. So
just to be completely clear, I mean I don't know that Richard and I, it's not the first,
it's not the area of primary concern for us in terms of, it wouldn't be the best seats in the
You know, Conigans never hardly ever used to open the back. I've never seen a single
person sit outside in 20 years.
I'm not sure that I would sit outside in its current state either. I don't know how it
was in years gone by. We are planning a full refurb, so we would intend to clean up all
areas of the premises, including the rear area, the outdoor area. It's kind of a TBC
for us. It's not an area that I'm particularly enamoured about in its current state, so it
would require some work to bring it up to the standard that we're looking to achieve.
Were we to do that, then management of that area would be several fold. We would only
take reservations at a certain time. There would also be seasonal pressures. We're not
to have the doors open in the midst of winter until those sort of times. So there would be a
natural closing of that area but I note that the council pointed out regarding the summer,
obviously warmer weather might prompt people to stay out there longer. So we would be very happy
to put limits in place around reservation times and then that would be constantly monitored. The
last thing we want to do is create a neighbourhood restaurant where the neighbours aren't happy.
it doesn't make sense. So that was outlined to the neighbours that I've met already with
Richards and we're very happy and willing to work with them in order that we don't have
a situation where the neighbours don't want to use the space.
Can I just say for Rosemary... Sorry, sorry, sorry. Just at this stage it's just questions from
members of the subcommittee. Thank you. Okay. Councillor Rathrove?
Thank you. My relation was kind of in line with what Councillor Rosemary was saying.
Just what is the capacity for the outdoor area and the capacity for inside as well?
The capacity inside is around 90 seats on the ground floor. It may be less in terms
of what furniture they actually buy. I think the fire risk assessment is up to 100 inside
the premises, but obviously that depends on the decor and the size of the seating that
Hamish and Richard decide on. It's not a matter of cramming people into the
premises either. It does need to have a comfort in terms of people will be
sitting down and dining and they want them to enjoy the space. In terms of the
outside seating, I think the rear has a maximum of about 20 seats if need be.
And I do believe Hamish that if need be you're happier to close the outside
space at a slightly earlier time at 10 .30 say in terms of that if that will
assist members. As he said, it sort of needs to be cleared up and made
pretty as well for that space. In terms of the front, that will be subject to a
pavement licence dealing that and that will have Wandsworth standard conditions
to deal with pavement licences as well. How many seats would you be looking at
at the front of the premises, Hamish? I think it's going to be in the range of
around 35 to 40 in all likelihood.
It's very difficult because I'm not entirely aware
of what's allocated to the premises
or if there's any allocation venue by venue.
Of course, there's the estate agents next door to us.
There's also space in front of them.
So I guess that's an exploratory process
when we come to a five -year -old.
And that will be done in due course
under the guise of the pavement licence application and consideration of the dimensions as well
and compliance with all of the Wandsworth requirements there as well.

go first and when you do speak obviously just make it clear what your position is.

Well I just wanted to mention, so I'm a local resident although I don't live on the street
but I spend a lot of time there.
All I was going to say is the other restaurants that have table pavement licences I think
called them. I think they all stay open until about eleven o 'clock. My son worked at Cooler
Sum until very recently and I know because I went to help him clear tables at night that it was
around eleven o 'clock at night and they were still clearing up sometimes at midnight. So there is
quite a lot of, you know, kind of busyness on that front pavement in the evenings. And then I just
had one other tiny question which no one's really alluded to but it was a big thing for me at
are you going to accept dogs in the restaurant?
Yes. Absolutely. I think Richard's other half is a fond dog lover.
Because Connegans used to be the only place until everyone started getting a bit more dog friendly.
Okay, if I have much if you don't mind me elaborating that I think what my vision is
our vision for the restaurant. I mean, I'm living there in my whole basically my whole life being
UK and then I always see as the perfect site if I ever want to venture my own, you'll be the site,
you know, and I love ones like this, you know, is there. Sorry to interrupt. Yeah, there shouldn't
really big questions at this point. So I should have been a bit further in my
chairing but this, we're now in the section where those making
representations either in support or against the application have the
opportunity to speak. So perhaps you'll have the opportunity for closing
remarks later as the applicant if that's okay. So I don't know, Sinead, if you had
here to make representations. Are you guys happy to... yeah up to you guys who
wants to go first whether you do hands virtual or just come in. Evan go for it.
So I own En8 which is the cafe across the street from the Conagan site and I
also live in Wandsworth town as a resident and have four or five years and
I just want to firmly make it aware that I'm very supportive of this premises
licence I think owning a business and seeing I don't want to say the decay but
the fact that there's like a vibrance that's been lost on Old York Road since
this restaurant which is obviously such a prominent spot on High
Street has closed and I think that a local restaurant be really really
beneficial I think it would help all the other local businesses in getting people
to the area and also just create a vibrancy that I think as both the
business owner and a resident I really miss so I have they have my full support.

Thank you. I'm absolutely delighted that this project is in prospect and I wish you every success.
We're the owners of the freeholders of the building next door.
I don't actually live there but I do have concerns for those in flats above
the shop next door and indeed other local residents especially if they have
small children in relation to noise and nuisance. My initial concerns were
twofold. One was the potential of noise from within. The withdrawal of the
application for live music went some way to reassuring me and the terms of
condition 11 go a lot further and attract to assuage my concerns very
considerably so I'm really I mean obviously the question of what gives
rise to nuisance is a subjective question but provided as I understand it the area to the rear
which is if the kind of glazed roof is part of the premises rather than part of the exterior
which therefore would be covered by condition 11 we are much reassured by that and I'm sure
whatever noise does emanate would be minimal. I was, I mean my chief concern
was this error on the appendix which about which I was assured I would be
run by a licencing officer during the last week but I haven't heard anything
so I'm now reassured that the two o 'clock in the morning on Friday and
Saturday is not going to be operating. I just remain with one
slight concern about about the areas in the area in the front really I suppose
and the original application on page 23 of the application the the hours for the
outside was stated as the same as the hours blindfold for the inside but the
appendix B indicates that they will be different and that satisfies our
concerns in that regard so thank you and good luck I'd say. Thanks very much.
Charlie did you want to come in next?
Absolutely, good evening everyone. I just want to make a presentation. I'm a local
resident. I live on Edna Street and so I'm literally less than 100 metre walk
from from the site along with a load of locals and friends in the area who are
in our 30s and 40s. I think that we would, you know, young children in the area, we see
ourselves as frankly the type of clientele that would be going to this
site regularly and we absolutely support this application. I think there's been a
real buzz about the conversations and how excited we are for there to be really a buzz
coming back to the high street. And when I say that, I mean as in the opportunity to
actually frankly put our money locally and not have to go to Fulham or Clapham or I don't
know, whatever it is, actually stay locally, enjoy ourselves and commit back to the community
locally and I think the offering that has been put forward is something that
everyone's incredibly excited by. So fully put our support by it and hopefully
very excited for a positive reaction. Thanks Charlie. Ben. Hi again I'm a local
resident two streets away and to be honest it's great to see someone moving
back into the area. It's a hole in the road. And it's a very obvious hole in the road.
It's nice to see a restaurant and we haven't got many we've got loads of bakeries, not
many restaurants. It's obviously a restaurant that we can really call our own and not have
to go up to try to not not to clap them. It's one of the common across the road is it'd
be great to see. And so I'm very much in favour.

This is just up for two minutes, so again any of those people, sorry yeah, any
one that made representations, is there anything else you want to add before we

anything. Thank you very much. So we've heard from local residents, it is very much going
to be a neighbourhood premises. We intend to tidy up the space, CCTV and all the conditions
proposed. We would say address what the concerns were from the objectors in terms of supporting
the licencing objectives. We certainly don't want to cause any issues with the neighbours,
we want them to come in and spend their money with us. If issues do arise, of course the
residents have the power of review and just remind members that there's no objections
from the police or environmental health as well and they're very satisfied with the conditions.
Richard, I'm going to come to you because you wanted to say a minute of what you wanted
to say earlier just so that you don't feel you've missed out.
Now that's okay.
Now just to finish off, as I say, it's a place to always want, if I want to ever go on my
to do something special there and even our business plans there is always the
community involved you know like it hurts me every time I want to go
somewhere and with my partner they would have nowhere to go and see the site
empty yeah the idea the concept is the place that you can come with your dog
and have a coffee and read a newspaper in the morning pass by after work have a
glass of wine and a steak or bring your parents and you have a nice dinner as a
You know, this is a community place. It's something that I want to do
Special well, I'm not gonna be using a lot because it'd be working but I'm doing for the community
You know, I wouldn't I say I want a place that it developed once of Tom, you know

And I'll just reiterate the hours applied for were the same as what Connegan's had and they are very important
To my clients business model as well
And we would say that the conditions that we've proposed in terms of the outside area and monitoring it
and the closing time of that earlier than inside,
we can very much promote the licencing objectives
and not cause nuisance to our neighbours.
